We may obtain information about you from your mobile device, such as your device type, machine or mobile device identification number, geo-location, time zone, language setting, browser type, and IP address.
We may obtain information about you from third parties for purposes of transaction processing, identity verification, fraud detection and prevention, and other similar purposes.
To the extent you utilize login information through a third party social network, we may obtain data regarding you from such network.
Messages you send through the Services to us, as well as other users and non-users.
HOW WE PROTECT & STORE PERSONAL INFORMATION
We store and process your personal information using third party servers located in secure data centers in the United States. This information is protected by physical, electronic and procedural safeguards in compliance with applicable US federal and state regulations.
We make reasonable efforts to ensure security on our systems and select providers of third party servers based on their reputation and commitment to do the same. Despite our efforts, we cannot guarantee that personal information may not be accessed, disclosed, altered or destroyed. Therefore, we urge you to take adequate precautions to protect your personal data as well, including never sharing your Payball password with anyone.
If we learn of a security breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Payball Services, you agree that the Company may communicate with you electronically. The Company may post a notice on the website or in the Payball Application if a security breach occurs. We may also send an email to you at the email address you have provided to us.
HOW WE USE PERSONAL INFORMATION
Our primary purpose in collecting personal information is to provide you with a safe, smooth, and efficient experience. We may use your personal information to:
Provide the services and customer support you request;
Process transactions and send notices about your transactions;
Resolve disputes, collect fees, and troubleshoot problems;
Prevent potentially fraudulent, prohibited or illegal activities, and enforce our User Agreement;
Customize, personalize, measure, and improve our Services and the content and layout of the Application;
Send you updates about new products and services that we are offering to customers;
Compare information for accuracy and verify it with third parties;
Perform other duties as required by law.
HOW WE SHARE PERSONAL INFORMATION WITH OTHER PARTIES
The Company has opened its Payball application programming interface in order to permit third parties to provide you with services (“Third Party Service Providers”). Notably, the payment processing and exchange of funds between users utilizing the Payball Services are conducted exclusively through third party services and software provided by Stripe. These Third Party Service Providers will also collect personal information from you and may do so through your use of the Payball Application. The Company has no liability or responsibility for the personal information you share with such third parties. Such matters will be governed by the agreements between you and the third parties.
We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure is: (i) reasonably necessary to comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; (ii) helpful to prevent, investigate, or identify possible wrongdoing; or (iii) protect our rights, reputation, property, or that of our users affiliates, or the public.
