In order to provide you with exceptional service, we may from time to time collect and use certain personal information about you. This policy explains how we collect, use, share and protect such personal information.


Throughout this policy, we use the term “personal information” to describe information that is associated with a specific person or that can be used to identify a specific person. We do not consider personal information to include information that is anonymous and that cannot be used to identify a specific user.

In order to provide the Services, we may collect and process certain information. Depending on your use of the Services, this may include:

Your name, email address, text-enabled cellular/wireless telephone number, machine or mobile device ID, street address, date of birth, last 4 digits of your social security number and/or employer identification number.

Identification documents, such as your driver’s license.

We may obtain information about you from your mobile device, such as your device type, machine or mobile device identification number, geo-location, time zone, language setting, browser type, and IP address.

To the extent you utilize login information through a third party social network, we may obtain data regarding you from such network.

Messages you send through the Services to us, as well as other users and non-users.


We may use cookies, web beacons, local shared objects, and similar technology in connection with your use of the Services (“Cookies”). Cookies may have unique identifiers, and reside, among other places, on the computer you use to access the Site and the mobile device on which you install the Payball Application, and in emails we send to you. Cookies may transmit information about you and your use of the Services, such as your browser type, search preferences, data relating to advertisements that have been displayed to you or that you have clicked on, and the date and time of your use. You may disable Cookies in your device or browser settings, but doing so may affect your ability to use the Services.


We store and process your personal information using third party servers located in secure data centers in the United States. This information is protected by physical, electronic and procedural safeguards in compliance with applicable US federal and state regulations.

We make reasonable efforts to ensure security on our systems and select providers of third party servers based on their reputation and commitment to do the same. Despite our efforts, we cannot guarantee that personal information may not be accessed, disclosed, altered or destroyed. Therefore, we urge you to take adequate precautions to protect your personal data as well, including never sharing your Payball password with anyone.

If we learn of a security breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Payball Services, you agree that the Company may communicate with you electronically. The Company may post a notice on the website or in the Payball Application if a security breach occurs. We may also send an email to you at the email address you have provided to us.


Our primary purpose in collecting personal information is to provide you with a safe, smooth, and efficient experience. We may use your personal information to:

Provide the services and customer support you request;

Process transactions and send notices about your transactions;

Resolve disputes, collect fees, and troubleshoot problems;

Prevent potentially fraudulent, prohibited or illegal activities, and enforce our User Agreement;

Customize, personalize, measure, and improve our Services and the content and layout of the Application;

Send you updates about new products and services that we are offering to customers;

Compare information for accuracy and verify it with third parties;

Perform other duties as required by law.


The Company has opened its Payball application programming interface in order to permit third parties to provide you with services (“Third Party Service Providers”). Notably, the payment processing and exchange of funds between users utilizing the Payball Services are conducted exclusively through third party services and software provided by WePay by Chase. These Third Party Service Providers will also collect personal information from you and may do so through your use of the Payball Application. Such matters will be governed by the agreements between you and the third parties.

The Company does not rent, share, sell or trade personally identifiable information with third parties for their direct marketing purposes. However, we may disclose certain personal information to Third Party Service Providers to facilitate their delivery of services to you. We may also share information from or about you with subsidiaries, joint ventures, or other companies under common control with us, in which case we will require them to honor this Privacy Policy.

We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure is: (i) reasonably necessary to comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; (ii) helpful to prevent, investigate, or identify possible wrongdoing; or (iii) protect our rights, reputation, property, or that of our users affiliates, or the public.
